Rubbish Clearance Barnes Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Clearance Barnes provides rubbish clearance and waste collection services to residential and commercial customers. By making a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any waste collection or clearance service.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation or other entity that requests or purchases services from Rubbish Clearance Barnes.
Services means any rubbish clearance, waste removal, waste collection, loading, transportation or associated services provided by Rubbish Clearance Barnes.
Waste means any items, materials or substances presented by the Customer for collection and disposal as part of the Services, subject to any exclusions in these Terms and Conditions and under applicable waste regulations.
Contract means the agreement between the Customer and Rubbish Clearance Barnes for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation provided by Rubbish Clearance Barnes.
Scope of Services
Rubbish Clearance Barnes provides a range of waste collection and rubbish clearance services, including but not limited to removal of household waste, garden waste, bulky items, office and commercial waste, and general non-hazardous rubbish. The precise scope of the Services will be as outlined in the quotation or booking confirmation supplied to the Customer.
The Customer is responsible for ensuring that the description of the Waste and access to the collection location are accurate. Rubbish Clearance Barnes reserves the right to amend the price or refuse to provide Services if the actual nature or volume of the Waste differs substantially from that described at the time of booking, or if there are access or safety issues at the collection location.
Booking Process
Bookings for waste collection and rubbish clearance services may be made by telephone, email or through any designated booking channel operated by Rubbish Clearance Barnes. When making a booking, the Customer must provide accurate and complete details, including:
Full name or business name;
Collection address and contact details;
Type and approximate volume or weight of Waste to be collected;
Any access restrictions or parking requirements;
Preferred date and time window for collection.
All bookings are subject to acceptance by Rubbish Clearance Barnes. A Contract is formed only when Rubbish Clearance Barnes confirms the booking, either in writing or verbally, and provides an agreed price or pricing basis. Rubbish Clearance Barnes may refuse any booking at its discretion.
The Customer acknowledges that any time and date for collection is an estimate only and may be subject to change due to traffic, operational or safety reasons. Rubbish Clearance Barnes will use reasonable endeavours to meet agreed collection time windows and will notify the Customer of any significant delays or the need to reschedule where reasonably possible.
Quotations and Pricing
Any quotation provided by Rubbish Clearance Barnes is based on the information supplied by the Customer at the time of enquiry, including the description, volume and nature of the Waste and the accessibility of the collection location. Quotations are usually given on a load, volume, weight or item basis and may specify any additional charges, such as congestion charges, parking costs, or surcharges for specific types of Waste.
If, upon arrival, the actual Waste or site conditions differ from that described by the Customer, Rubbish Clearance Barnes may revise the price to reflect the additional work, time, disposal costs or safety measures required. The Customer will be informed of any revised price before work continues. If the Customer does not accept the revised price, Rubbish Clearance Barnes may cancel the Service and the Customer may be liable for a call-out or cancellation charge.
Payments and Charges
The Customer agrees to pay all charges for the Services in accordance with the price and payment terms agreed at the time of booking or as subsequently updated with the Customer’s consent. Prices are stated inclusive or exclusive of VAT in accordance with applicable law and as notified to the Customer.
Payment is generally due on completion of the Services, unless otherwise agreed in advance. Rubbish Clearance Barnes may require full or partial payment in advance, particularly for larger or commercial collections. Accepted payment methods will be communicated at the time of booking and may include card payment, bank transfer or cash, subject to any operational policies in place at the time.
For business and account customers, payment terms may be agreed separately in writing. In the absence of such agreement, payment is due on or before completion of the Services. Rubbish Clearance Barnes reserves the right to charge interest on any overdue sums at the statutory rate in force for late payments, together with any reasonable costs incurred in recovering the outstanding amount.
Cancellations and Rescheduling
The Customer may cancel or reschedule a booking by providing reasonable notice to Rubbish Clearance Barnes. Where possible, at least 24 hours notice before the scheduled collection time is requested to avoid cancellation charges.
If the Customer cancels a booking with less than 24 hours notice, or if the crew arrives on site and is unable to complete the clearance due to circumstances within the Customer’s control, Rubbish Clearance Barnes reserves the right to charge a cancellation or call-out fee to cover administrative, travel and staffing costs.
Rubbish Clearance Barnes may cancel or reschedule a booking due to operational, safety, legal or regulatory reasons, including severe weather, vehicle breakdown, traffic disruption, or discovery of prohibited or hazardous Waste. In such cases, Rubbish Clearance Barnes will make reasonable efforts to notify the Customer and to arrange an alternative collection time. Rubbish Clearance Barnes will not be liable for any loss or inconvenience arising from such cancellations or rescheduling, save as required by law.
Customer Obligations
The Customer must ensure that:
The Waste to be collected is accurately described and falls within the categories of Waste that Rubbish Clearance Barnes is permitted and equipped to handle;
Any hazardous, clinical, chemical or prohibited Waste is disclosed in advance and not presented for collection unless Rubbish Clearance Barnes has expressly agreed to handle such materials in compliance with applicable regulations;
Reasonable access is provided to the collection location, including safe access to the Waste, and that any necessary permissions for entry, parking or loading have been obtained;
There are no health and safety risks that have not been disclosed, such as structural hazards, dangerous animals, or exposure to harmful substances.
The Customer agrees to cooperate with the crew on site, follow any safety instructions, and confirm which items are to be removed. Rubbish Clearance Barnes will not be liable for removing items in error where the Customer has failed to clearly identify which items should be taken or left.
Waste Regulations and Prohibited Items
Rubbish Clearance Barnes operates in accordance with applicable UK waste regulations, including requirements relating to waste carrier licensing, duty of care, and the correct handling, transfer and disposal of controlled Waste. All collected Waste will be transported to appropriate, licensed facilities such as transfer stations, recycling centres or authorised disposal sites.
Certain types of Waste are hazardous or subject to special controls and cannot be collected as part of standard Services. These may include, without limitation, asbestos, clinical or medical waste, gas cylinders, certain chemicals, flammable or explosive materials, and specific electrical or electronic equipment that requires specialist disposal methods. The Customer must inform Rubbish Clearance Barnes in advance if such Waste is present.
If prohibited or undisclosed hazardous Waste is discovered on site, Rubbish Clearance Barnes may refuse to handle it, may suspend or terminate the Services, and may charge the Customer for any additional costs or losses incurred. The Customer remains responsible for any consequences of incorrectly describing or presenting prohibited Waste.
Service Delivery and Performance
Rubbish Clearance Barnes will carry out the Services with reasonable skill and care and in a professional manner. The crew will use reasonable endeavours to minimise disruption and to leave the area from which Waste has been removed in a reasonably tidy condition, bearing in mind the nature of the work.
Rubbish Clearance Barnes does not undertake structural alterations, demolition of buildings, or works requiring specialist construction or trade skills unless expressly agreed. Light dismantling of items such as furniture or fixtures may be carried out where necessary to facilitate removal, but is at the discretion of the crew and subject to safety considerations.
Liability and Limitations
Nothing in these Terms and Conditions excludes or limits the liability of Rubbish Clearance Barnes for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under UK law.
Subject to the foregoing, Rubbish Clearance Barnes will not be liable for any indirect, consequential or economic losses, including loss of profit, loss of business, loss of data or loss of opportunity, arising out of or in connection with the provision of the Services or any delay or failure to provide them.
Rubbish Clearance Barnes liability for direct loss or damage to property arising from its negligence or breach of Contract shall, to the fullest extent permitted by law, be limited to the lesser of the total price paid by the Customer for the relevant Services or a reasonable sum reflecting the value of the damaged property, taking into account age, wear and tear and condition.
The Customer is responsible for removing or securing any fragile, valuable or delicate items prior to the commencement of the Services. Rubbish Clearance Barnes accepts no liability for damage to items that the Customer has left in or on Waste intended for disposal, or that could not reasonably be identified as items to be retained.
Insurance
Rubbish Clearance Barnes maintains appropriate insurance cover in respect of its legal liabilities in connection with the provision of the Services. Details of insurance arrangements may be provided to the Customer on request. The existence of insurance does not extend or increase the liability of Rubbish Clearance Barnes beyond that set out in these Terms and Conditions or required by law.
Events Beyond Our Control
Rubbish Clearance Barnes will not be liable for any delay in performing, or failure to perform, any of its obligations under the Contract where such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, extreme weather, natural disasters, accidents, fires, breakdown of vehicles, strikes, lockouts, civil commotion, acts of terrorism, or compliance with any law or governmental order.
Where an event beyond its control occurs, Rubbish Clearance Barnes will use reasonable endeavours to notify the Customer and to resume the Services as soon as reasonably practicable.
Complaints
If the Customer is dissatisfied with any aspect of the Services, they should contact Rubbish Clearance Barnes as soon as possible, providing full details of the issue, the date of the Service and any supporting information. Rubbish Clearance Barnes will investigate the complaint and seek to resolve it fairly and promptly. Any adjustments, refunds or remedial work will be at the discretion of Rubbish Clearance Barnes and in accordance with applicable consumer protection laws.
Data Protection and Privacy
Rubbish Clearance Barnes will process any personal information provided by the Customer in connection with the Services in accordance with applicable data protection laws. Personal data will be used for purposes such as managing bookings, providing Services, processing payments, and handling enquiries or complaints. Rubbish Clearance Barnes will take reasonable steps to keep personal information secure and will not share it with third parties except where necessary to provide the Services, comply with legal obligations, or with the Customer’s consent.
Variation of Terms
Rubbish Clearance Barnes may amend these Terms and Conditions from time to time to reflect changes in law, industry practice or operational requirements. The version of the Terms and Conditions that applies to a particular Contract will be the version in force at the time the Customer’s booking is confirmed. Updated terms may be made available on request.
Severability
If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision or part-provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
Governing Law and Jurisdiction
These Terms and Conditions, and any Contract between the Customer and Rubbish Clearance Barnes, are governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter or formation, including non-contractual disputes or claims.
